Relationship with God can’t be defined by biology, says SC

While ending years old practice that banned women between the age of 10 and 50 from entering Sabarimala Temple, the SC asserted that femininity should not be a constraint in relationship between human and God. It said that “Patriarchy in religion cannot be allowed to trump right to pray and practise religion.” The court also observed that the practice is discriminatory which violates rights of Hindu women. “Any rule based on biological characteristics cannot pass muster of constitutional test,” said the CJI Dipak Misra who headed the bench. “Physiological features cannot be a ground for denial of right,” said the five-member constitution bench comprising justices Dipak Misra, Rohinton Nariman, AM Khanwilkar, DY Chandrachud, and Indu Malhotra.
