SC says adultery law discriminates fundamental right

The SC observed that Section 497 IPC that makes sexual relationship without the consent of husband as punishable offence is discriminatory. Since sexual freedom is a fundamental right, it asked, why then adultery remains as a criminal law punishing only man. The CJI termed it as manifestly arbitrary, discriminatory and suffering from gender bias.
